At Gamer Fresh, we are committed to honest, transparent advertising. In compliance with New York State Law S.8420-A, we provide the following disclosure regarding our use of artificial intelligence in commercial advertising.


Disclosure: Use of Synthetic Performers

Some of our commercial advertisements may feature synthetic performers — digitally created visual assets generated using generative AI technology that are intended to resemble a human figure but do not represent any identifiable real person.

Where synthetic performers are used in our advertising, this disclosure serves as the required conspicuous notice under New York law.


About New York State Law S.8420-A

New York's AI advertising disclosure law (S.8420-A), enacted in December 2025 and effective June 9, 2026, requires advertisers to provide a clear and conspicuous disclosure in any commercial advertisement that features a synthetic performer — a digitally created asset using generative AI intended to look like a human but not recognizable as an identifiable natural person.

Key provisions of the law include:

  • Scope: The requirement applies to advertisers who have actual knowledge of the synthetic performer's inclusion. It does not apply to media outlets or platforms that publish the ads.
  • Exemptions: Advertisements for expressive works (e.g., movies, TV shows, video games) are exempt if the use of synthetic performers is consistent with the work itself. Audio-only advertisements and uses of AI solely for language translation are also exempt.
  • Disclosure Format: The law does not specify an exact format; advertisers must determine the method of disclosure (e.g., text label, visual indicator), provided it is conspicuous.
  • Penalties: Civil penalties of $1,000 for a first violation and $5,000 for subsequent violations may apply.

Related Legislation: Right of Publicity (S.8391)

A separate New York law (S.8391), effective immediately, requires consent from the heirs or executors of a deceased New York resident before using their name, voice, or likeness for commercial purposes. This law expands right of publicity protections against unauthorized digital replicas. Gamer Fresh is committed to full compliance with this legislation as well.
